Terms and Conditions of Sale

1. Scope of Application

These General Terms and Conditions of Sale (GTCS) apply to all sales of paintings and prints concluded between the seller Ekaterina Grivet and any person making a purchase via the website https://ekaterinagrivet-art.ch, hereinafter referred to as “the customer”.

The customer declares having read these GTCS prior to placing an order. Any order placed via the website implies full and unconditional acceptance of these GTCS.


2. Payment

Payment is made online via a secure external system. We use the PayPal payment platform, which also allows payment by credit card.
The order is confirmed once the full amount has been received.

The customer may make payment by selecting from several currencies offered on the website (CHF, EUR, USD, etc.). The displayed prices automatically adjust to the selected currency.
For customers domiciled in Switzerland, prices include Swiss VAT.
For customers located outside Switzerland, prices are displayed excluding taxes. The customer is therefore responsible for the payment of any applicable local taxes, customs duties, or import fees required by the authorities of the delivery country.

Shipping costs are not included in the price of the artwork. They are automatically calculated and clearly indicated at the time of cart validation, before final payment.

The seller reserves the right to modify prices at any time; however, products are invoiced based on the rates in effect at the time the order is placed.


3. Delivery

Deliveries are made within Switzerland and internationally, according to the options offered on the website.
The indicative delivery time is specified when placing the order. In the event of a delay or non-receipt, the customer may contact customer service at the address above.
If the carrier loses the parcel, a replacement or a refund will be offered.


4. Warranty and Defects

The products sold benefit from the statutory warranties provided for by the Swiss Code of Obligations (CO), in particular with regard to material defects.
The customer must check the condition of the artworks upon delivery. Any visible defect or delivery error must be reported within 7 days by email, accompanied if possible by photographs. In the event of a proven defect, a replacement or a refund will be offered.
The seller shall not be held liable for damage caused by improper handling or improper storage of the product by the customer.


5. Right of Withdrawal

Under Swiss law, there is no statutory right of withdrawal for distance sales (unlike in the European Union). However, in the interest of transparency and customer satisfaction, we grant a contractual right of return of:
14 calendar days from receipt of the order.
The customer may cancel the order by notifying their decision by email to: info@ekaterinagrivet-art.ch

The products must be returned at the customer’s expense, in perfect condition, in their original packaging, and accompanied by all original elements (certificate of authenticity, documentation, etc.) within 14 days following notification of the withdrawal decision.

⚠️ Any product returned incomplete, altered, damaged, or soiled will not be refunded or exchanged. In the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the goods, the customer’s liability may be engaged.
Customized products or works made to order are excluded from the right of return.


6. Personal Data

The data collected when placing an order is processed confidentially and used solely for order processing, customer communication, and accounting obligations.
In accordance with the Swiss Federal Act on Data Protection (FADP) and the European GDPR, the customer has the right to access, rectify, and delete their data.

No personal data is sold or transmitted to third parties for advertising purposes.


7. Intellectual Property

All content present on the website, including artworks, images, texts, and logos, is the exclusive property of Ekaterina Grivet.
Any reproduction or use, even in part, is prohibited without prior written authorization from the rights holder. The purchase of an artwork entails no transfer of copyright.


8. Applicable Law and Jurisdiction

These GTCS are governed by Swiss law. In the event of a dispute, an amicable solution will first be sought.
Failing agreement, any dispute shall be submitted to the District Court of Lausanne.
